Badgers and their setts are protected under the Protection of Badgers Act 1992, and are frequently encountered on development projects. A licence from Natural England is needed if disturbing work is planned close to a sett, as well as for any 'exclusions', sett closures or sett destruction.

Where a sett needs to be closed and badgers excluded prior to sett destruction for the purposes of development, a licence is likely to be granted only between July and November inclusive (i.e. outside the badger breeding season) making it vital to consider badgers at an early stage in the development process.
